Charges against a man involved in the stabbing of a dairy owner in Auckland last month have been dismissed.

Mitchell Lam, who was 24, died in custody facing charges of wounding with intent to cause grievous bodily harm and resisting police.

Police say Lam entered a shop in the central suburb of New Windsor and attacked the dairy owner and his wife with a knife.

Today police sought to have a stay of proceedings at the Auckland District Court and the judge agreed, ending the trial.

No information on the cause of Lam's death have been released.
